Insight Terms of Use Agreement
The INSIGHT PARTNER PORTAL is at present a pilot website but it is hoped eventually that it will be a service that allows anyone, anywhere to communicate their Participatory Videos and their views and ideas around this type of media.
The following is a legal document however the members of the portal will develop an Ethical Policy for content displayed and also a guide for the conduct of the website users. It is in the Ethos of Participatory Media that the creators of and those persons appearing in i.e. Participatory Videos, are in agreement that that it can be shown to external audiences without changes, with due acknowledgement to the source.
Discussion and comments are welcomed expressing views about any content on this website, as long as all communication constructive and is respectful of other people and other people's opinions.
The Partner Portal (name may change) is presented by INSIGHT in association with a range of allies globally. The website is hosted in the U.K.
This Terms of Use Agreement (“Agreement”) sets forth the legally binding terms for your use of the Hub. In addition, please review the Privacy Statement available here which is incorporated into this Agreement by reference as if set forth fully herein. By using this website, you agree to be bound by this Agreement, whether you are a “Visitor/Guest” (which means you browse the website or you are a “Member” (which means that you have registered with http://partnerportal.gn.apc.org. The term “User” refers to a Visitor or a Member.
You are only authorized to use this website (regardless of whether your access or use is intended) if you agree to abide by all applicable laws and this Agreement. Please read this Agreement carefully. If you do not agree with it, you should leave the Hub and discontinue all use of the Hub immediately. If you wish to become a Member, you must read this Agreement and indicate your acceptance during the registration process.
This Agreement includes INSIGHTS’ policy for acceptable use of this website and Content posted on this website, your rights, obligations and restrictions concerning your use of this website and INSIGHTS’ privacy policy. In order to participate in certain portions of this website, you may be notified that you have to agree to additional terms and conditions, which are hereby incorporated into this Agreement.
INSIGHT may modify this Agreement from time to time and such modification shall be effective upon posting the modified agreement on this Website, http://partnerportal.gn.apc.org. You agree to be bound to any changes to this Agreement when you use this website after any such modification is posted. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes.
Please choose carefully the Content (including videos, images or text) that you upload to the Hub.
Content posted by Members may contain inaccurate, inappropriate, offensive or sexually explicit material, products or services, and INSIGHT assumes no responsibility or liability for this material. If you become aware of misuse of this website by any person, please contact INSIGHT.
INSIGHT reserves the right, in its sole discretion, to reject, refuse to post or remove any posting by you, or to restrict, suspend or terminate your access to all or any part of this website at any time, for any or no reason, with or without prior notice, and without liability. INSIGHT expressly reserves the right to restrict, suspend, or terminate your access to any part of this website if INSIGHT determines, in its sole discretion, that you pose a threat to INSIGHT and/or its Users.
Eligibility
Use of and Membership in this website is void where prohibited. By using this website, you represent and warrant that: (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 14 years of age or older; (d) your use of this website does not violate any applicable law or regulation; and (e) you will not impersonate any person or entity, including but not limited to, an INSIGHT employee, forum leader, guide or host or falsely state or otherwise misrepresent your affiliation with a person or entity. Your profile may be deleted and your Membership may be terminated without warning, if INSIGHT believes that you are under 14 years of age or determines, at its sole discretion, that you have used a false identity in registering to use this website.
Term
This Agreement shall remain in full force and effect while you use this website or are a Member. You may terminate your Membership at any time, for any reason, and delete your profile. All your details that appear publicly on the website can be edited or removed by you except for your username. Please contact the Portal Coordinator immediately if you wish your account to be completely removed. Please do this by sending an email to the Portal Coordinator using the Contact Form, or sending an email to partnerportal@gn.apc.org. INSIGHT may terminate your membership and delete your profile at any time, without warning. Even after Membership is terminated, this Agreement will remain in effect.
Password
When you sign up to become a Member, you will also be asked to choose a password. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member at any time or to disclose your password to any third party. You agree to notify INSIGHT immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account.
Non-commercial Use by Members
This website (http://partnerportal.gn.apc.org) is for the personal use of Visitors only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by INSIGHT. Illegal and/or unauthorized use of this website, including collecting usernames and/or email addresses of Visitors by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to this website is prohibited. Content containing commercial advertisements, affiliate links, and other forms of solicitation may be removed from the website without notice and may result in termination of Membership privileges.
Proprietary Rights in Content on the Hub Website
INSIGHT does not claim any ownership rights in the text, files, images, photos, video, sounds, musical works, works of authorship, or any other materials (collectively, “Content”) that you post to this website. After posting your Content to the Hub, you continue to retain all ownership rights in such Content, and you continue to have the right to use your Content in any way you choose.
By displaying or publishing (“posting”) any Content on or through this website, you hereby grant to INSIGHT a non-exclusive, worldwide, royalty-free, sublicensable (through multiple tiers) license to (and give others the right to) use, copy, display, perform, distribute, adapt, modify and promote the Content that you post to the Hub and in any other medium, now existing or hereafter developed, for educational, archival and non-commercial promotional use.
You additionally acknowledge that all Content uploaded to the Hub, whether by you or another Member, may have a Creative Commons license applied to it by you or the uploading Member, as the case may be. You may change this license at any time, or decline to apply a license, but, in any event acknowledge that INSIGHT shall not be liable for any uses of your Content under a Creative Commons license.
You represent and warrant that: (i) you own the Content posted by you on or through this website or otherwise have the right to post the Content to the Hub, and (ii) the posting of your Content on or through this website does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any Content posted by you to or through this website.
Content Posted
INSIGHT may delete any Content that in the sole judgment of INSIGHT violates this Agreement or which may be offensive, illegal or violate the rights, harm, or threaten the safety of any person. INSIGHT assumes no responsibility for monitoring this website for inappropriate Content or conduct. If at any time INSIGHT chooses, in its sole discretion, to monitor this website, INSIGHT nonetheless assumes no responsibility for the Content, no obligation to modify or remove any inappropriate Content, and no responsibility for the conduct of the User submitting any such Content.
You hereby acknowledge that INSIGHT may edit or encrypt any Content uploaded to the Hub if such editing or encryption is necessary, in INSIGHTS’ sole discretion, to protect the privacy of individuals depicted in the applicable Content.

Content/Activity Prohibited
The following is a partial list of the kind of Content that is illegal or prohibited to post on or through this website. Prohibited Content includes, but is not limited to Content that, in the sole discretion of INSIGHT:

- advertising to, or solicitation of, any Member to buy or sell any products or services through the Hub;
- interfering with, disrupting, or creating an undue burden on this website or the networks or services connected to the Hub;
- using the account, username, or password of another Member at any time or disclosing your password to any third party or permitting any third party to access your account;
- selling or otherwise transferring your Membership;
- using any information obtained from this website in order to harass, abuse, or harm another person;
- displaying an advertisement in your Content, or accepting payment or anything of value from a third person in exchange for your performing any commercial activity on or through the Hub on behalf of that person, such as posting blogs or bulletins with a commercial
- using the Hub in a manner inconsistent with any and all applicable laws and regulations.
It is also a violation of these rules to use any information obtained from this website in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent.
Copyright Policy
Except as otherwise provided in the Creative Commons License, you may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. It is the policy of INSIGHT to terminate Membership privileges of any Member who repeatedly infringes the copyright rights of others upon receipt of prompt notification to INSIGHT by the copyright owner or the copyright owner’s legal agent.
Privacy Policy
Use of this website is also governed by our Privacy Policy, which is incorporated into this Agreement by this reference. You agree that INSIGHT can export your information to any country as operationally necessary, even if that country’s privacy laws are weaker or different from the privacy laws of your country and that INSIGHT can use and transfer your information to the extent provided in the Privacy Policy.
Violation of Intellectual Property Rights, Laws and Terms of Use
Provided proper notification, INSIGHT will remove any contributed content that infringes upon the intellectual property rights of another or unless as otherwise required by law and reserves the right to remove such content without prior notice. INSIGHT assumes no responsibility for monitoring this website and any content uploaded thereto by third parties. In the event it chooses to do so at its discretion, INSIGHT assumes no responsibility for the infringing content or any obligation to remove any inappropriate content or any responsibility for the conduct of a Member submitting inappropriate content. At its sole discretion, INSIGHT may remove any content and/or terminate a Member’s account for violating any of the terms of use set forth in this Agreement at any time and without notice, including, without limitation, use of false identity for the purposes of registration to use this website. INSIGHT reserves the right, but not the obligation, to take any appropriate legal action for any illegal or unauthorized use of this website or violation of this Agreement.

Content posted by Members on this website may contain links to other websites. INSIGHT is not responsible for the Content, accuracy or opinions expressed on such websites, and such websites are in no way investigated, monitored or checked for accuracy or completeness by INSIGHT. Other
This Agreement is accepted upon your use of the Hub and is further affirmed by you becoming a Member. This Agreement constitutes the entire agreement between you and INSIGHT regarding the use of this website (http://partnerportal.gn.apc.org). The failure of INSIGHT to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
